 TERMS AND CONDITIONS OF SALES

 

WARRANTY: MACK Industrial, LLC warrants all products bearing its nameplate to be free from defects in material and workmanship which appear before the expiration of sixty (60) days from the date of original shipment to the Buyer.  MACK Industrial, LLC will repair or replace any products found to be defective which are returned to its facility within the warranty period or will credit the purchase price, as it may elect.  This shall be the sole and exclusive liability of MACK Industrial, LLC and remedy of the Buyer agrees that no other liability or remedy (including but not limited to: any recovery of incidental or consequential damages for lost profits, lost sales, lost labor time, injury to person or property, or any other incidental or consequential loss) shall be available to the buyer as a result of using the product in its intended application or any other application.  NO WARRANTY MERCHANT-ABILITY OF OR FITNESS FOR A PARTICULAR PURPOSE SHALL APPLY.  Any action for breach of this Agreement, other than non-payment shall be forever barred unless commenced within one (1) year after the cause of action has accrued.  MACK Industrial, LLC makes no warranty and assumes no responsibility with respect to any products not supplied by MACK Industrial.  The products are not guaranteed as to performance under specific use.

 

RETURN POLICY: Merchandise can be returned only with MACK Industrial, LLC's written authorization and an assigned return of product number.  All returns must be shipped by the Buyer, or a written request for pickup of the defective product must be issued within the warranty period.  Special order items are non-returnable.  Credit will be issued after inspection of returned products, and the only items that MACK Industrial, LLC will accept are products that are received in similar condition as they were shipped to the Buyer on the date of original shipment.

 

DAMAGE IN TRANSIT: Unless otherwise agreed, all material is shipped FOB MACK Industrial, LLC's facilities.  Damage occurred during transit (whether concealed or otherwise) is not the responsibility of MACK Industrial, LLC. It is the responsibility of the Buyer to make a claim with and collect from the freight company for visibly damaged or missing articles.  MACK Industrial, LLC will assist the Buyer during the claim process if registered.

 

SPECIFICATIONS: Certification of specifications will be provided at Buyer's request.  All specifications and prices are subject to change without notice.

 

TERMS OF PAYMENT: Standard terms of payment are PREPAID (Credit Card or Bank Transfer).  NET30 terms are available upon approval of credit.
